Para abordar este tema temos que entender o que significa direito autoral. De acordo com a lei 9610 de 19 de fevereiro de 1998, direito autoral ou direitos autorais são as denominações utilizadas em referência ao rol de obras intelectuais que podem ser literárias, artísticas ou científicas. Neste rol encontram-se dispostos direitos de diferentes naturezas. São divididos em direitos morais, que são os direitos de natureza pessoal e os direitos patrimoniais que se referem aos de natureza patrimonial.
Atualmente orientamos os alunos para sempre citarem a fonte da qual retiram as informações, mas conforme nova lei que está no senado, de autoria do senador Eduardo Azeredo (PL 84/99), que pretende penalizar as pessoas que utilizam textos, imagens, sons, vídeos disponíveis na internet, percebemos que haverá mudanças no trabalho na sala informatizada com os alunos, pois como faremos para exibir textos, imagens e sons em: trabalhos, blogs, sites, rádio escola, festas educativas que são desenvolvidos no ambiente escolar?
Sabemos que este é um assunto muito polêmico e que demandará muito tempo de reflexão e estudo. Acreditamos que uma das possíveis alternativas seria o conceito de copyleft (permissão de cópia) em oposição ao modelo atual, copyright (direito de cópia). O conceito copyleft propõe a inversão das leis de propriedade intelectual: ao licenciar uma obra, o titular permite expressamente a qualquer um sua live utilização, reprodução, divulgação e mesmo modificação, ressalvando que ninguém poderá adicionar restrições, inclusive a obras derivadas que vier a produzir.
Pensando nesta alternativa, utilizaremos somente obras literárias, musicais e científicas licenciadas sob modelos inspirados em copyleft? Se for assim, nosso trabalho ficará muito restrito.
